Terms and Conditions

Wavcart is a product built and operated by ThinkSuite Solutions ("ThinkSuite", "Company"). ThinkSuite is the legal entity responsible for the Wavcart platform, including its WhatsApp, RCS, Email, and Social Media automation products.

All user accounts, subscriptions, payment collection, billing, and accounting on the Wavcart platform are managed exclusively by ThinkSuite Solutions. Any financial transaction you make on the Wavcart platform is between you and ThinkSuite.

By registering for, accessing, or using any Wavcart service, you agree to be bound by these Terms and Conditions ("Terms"). These Terms form a legally binding agreement between you and ThinkSuite Solutions ("Wavcart", "we", "us").

If you do not agree to these Terms, you must not use our services.

• You must be at least 18 years of age to use Wavcart
• You must be a legally registered business entity or individual operating in India
• You must have a valid WhatsApp Business account (for Automate features)
• Accounts registered on behalf of a business must be authorised to bind that business to these Terms

You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Ensuring your account information is accurate and up to date
• Notifying us immediately of any unauthorised access at work@thinksuite.in

We reserve the right to suspend or terminate accounts where security is compromised or Terms are violated.

You may use Wavcart services only for lawful business purposes, in compliance with:

• These Terms and all applicable Indian laws and regulations
• Meta's WhatsApp Business and Commerce Policies
• Information Technology Act, 2000 and amendments
• Consumer Protection Act, 2019
• Any applicable TRAI regulations on commercial communications

You must NOT use Wavcart to:

• Send unsolicited messages (spam) to contacts who have not opted in to receive communications from you
• Broadcast illegal, defamatory, obscene, or harmful content
• Violate Meta's WhatsApp Business Policy or API usage guidelines
• Attempt to exceed your plan's broadcast limits or circumvent usage restrictions
• Scrape, harvest, or collect data from the platform without authorisation
• Impersonate any person, business, or entity
• Use the platform for phishing, fraud, or any deceptive practice
• Distribute malware or any malicious code
• Share content that exploits or harms minors in any way

Violation of these rules may result in immediate account suspension without refund and may be reported to law enforcement authorities.

Wavcart is an independent service that uses Meta's WhatsApp Business API. Message delivery is subject to Meta's platform availability and policies. We do not guarantee 100% message delivery. You are responsible for ensuring all WhatsApp templates are approved by Meta before use and that your messaging complies with WhatsApp's terms.

• New WhatsApp Automation accounts can send 10 messages free to try the platform, no payment required
• Paid plans are charged in advance for one month at a time, at the price shown on our pricing page
• Plans do not renew automatically. To continue, renew from your billing page; renewing before the current period ends adds a month to it
• Prices are listed in Indian Rupees (INR) and are exclusive of GST (18%)
• All payments are collected directly by ThinkSuite Solutions via Razorpay
• We reserve the right to change pricing with 30 days advance written notice

By subscribing to any Wavcart plan, you are entering into a billing relationship with ThinkSuite Solutions, who is solely responsible for payment collection, invoicing, GST compliance, and accounting. All billing correspondence and receipts will be issued by ThinkSuite.

All content, features, software, branding, and intellectual property on the Wavcart platform are owned by or licensed to ThinkSuite Solutions. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

You retain ownership of all content and data you upload to the platform (contacts, products, broadcast messages). By uploading content, you grant us a limited licence to process it solely for the purpose of delivering our services to you.

To the maximum extent permitted by applicable law, Wavcart and ThinkSuite Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity.

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the amount you paid to ThinkSuite in the 3 months preceding the claim.

Wavcart services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free from viruses. Message delivery via WhatsApp is subject to Meta's network availability and is not guaranteed.

Either party may terminate the agreement at any time. You may stop using a paid plan at any time by not renewing it; access continues until the end of the period already paid for. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to access the platform ceases and your data will be handled as per our Privacy Policy.

These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through mutual negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

We may revise these Terms at any time. Material changes will be communicated via email or in-platform notification at least 14 days before taking effect. Your continued use after that date constitutes acceptance of the updated Terms.
